These Terms of Use (the “Terms” or “Terms of Use”) govern your access to and use of the services, programs, and content provided by Firefighter Peak Performance, LLC, whether accessed: (a) on a computer connected to the internet at https://firefighterpeakperformance.com (the “Website”); (b) on Firefighter Peak Performance social media properties; (c) through third-party platforms used by the Company to deliver programs, memberships, digital products, training services, or coaching (including but not limited to Kajabi, BridgeAthletic, and similar platforms); or (d) by mobile device (individually and collectively referred to as the “Product”).
The Product is owned and operated by Firefighter Peak Performance, LLC (“Company”, “Trainer”, “we”, “us”, or “our”), a limited liability company organized in the State of Washington, United States, with its principal business address at:

These Terms govern the use of all persons using the Product and apply to you from the time that you access the Product. For clarification, “You” includes terms such as “your” and “yourself”.
2. APPROVAL OF THE TERMS
It is important that you read these Terms carefully. If you do not agree to these Terms, please do not use the Product or browse the Website.
By accessing or using the Product, you represent, warrant and signify that:
You are at least eighteen (18) years of age.
You have read, understood, and agree to be bound by these Terms as they may be amended from time to time.
You have read and understand our Privacy Policy, which can be accessed through the Website, the terms of which are incorporated herein by reference.
You may not use the Product nor accept these Terms if you are not of legal age to form a binding contract with the Company.
If you accept these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.
3. AMENDMENT
The Company may revise these Terms from time to time.
We may amend the Terms without notice for non-material changes. In the event of a material change, we will provide reasonable notice through the Website or by email to the address supplied by you.
Unless explicit consent is required by law, continued use of the Product following any amendment constitutes acceptance of the revised Terms.
The most current version of the Terms will always be available on the Website.
4. PAYMENT TERMS
Payment for services, programs, coaching, memberships, and digital products offered through the Product is due upon purchase or according to the applicable subscription billing cycle.
The Company may issue invoices electronically and may process payments through secure third-party payment processors including but not limited to Stripe, PayPal, Kajabi payment systems, or QuickBooks invoicing services.
Any amounts payable which remain unpaid fifteen (15) days after an invoice is delivered shall bear interest at the rate of 1.5% per month (up to a maximum of 18% per annum), or the maximum amount allowable by law.
Users may be required to provide account information for at least one valid debit or credit card.
The Company shall not be liable for payments that cannot be processed because:
Your debit or credit card does not contain sufficient funds.
Incorrect payment information has been provided.
The card has expired.
Circumstances beyond the Company’s control interrupt payment processing.
All payments are exclusive of any taxes or duties imposed by applicable tax laws.
5. TERMINATION
These Terms are effective from the moment you access the Product and continue until the relationship between you and the Company is terminated.
You may terminate your relationship with the Company at any time by contacting:

Services will continue until the end of the current billing or subscription period.
The Company may terminate your access to the Product immediately if you:
Breach these Terms
Fail to pay applicable fees
Misuse the Product
Violate applicable laws
Engage in behavior that harms the Company or other users
Upon termination, the Company may revoke access to the Product and remove account access after thirty (30) days.
Accounts inactive for twelve (12) months may be cancelled following fourteen (14) days notice.
6. USE OF THE PRODUCT
Users may access the Product through the Website or through third-party platforms used by the Company to deliver training programs, digital products, memberships, and coaching services.
You are responsible for maintaining the confidentiality of your login credentials.
Registration information must remain accurate and up to date.
You agree not to:
Impersonate another user
Attempt to gain unauthorized access to the Product
Use automated tools to access the Product
Reproduce or distribute Product content without permission
Use the Product for unlawful purposes
Use of the Product requires internet access and a modern web browser with cookies enabled.
7. PRIVACY
Your privacy is important to us.
Please review our Privacy Policy, which explains how personal information is collected, used, stored, and protected.
The Privacy Policy is incorporated into these Terms by reference.
8. THIRD-PARTY LINKS
The Product may include links to third-party websites or services.
These links are provided for convenience only.
The Company does not control and is not responsible for the availability, accuracy, or content of such third-party websites.
9. INTELLECTUAL PROPERTY RIGHTS
All Product content, including training materials, videos, documents, graphics, branding, and software, is the intellectual property of Firefighter Peak Performance, LLC.
You are granted a limited, non-exclusive, non-transferable license to access and use the Product for personal or authorized use.
You may not reproduce, distribute, modify, or create derivative works based on Product content without written permission from the Company.
All trademarks, branding, and related intellectual property associated with Firefighter Peak Performance remain the property of the Company.
10. DISCLAIMERS
The Product is provided on an “as-is” and “as-available” basis without warranties of any kind.
Training programs, coaching services, and educational materials provided through the Product are intended for informational and educational purposes only.
Participation in physical training programs carries inherent risks.
You acknowledge that you are responsible for determining whether participation in any exercise program is appropriate for your health and physical condition.
The Company assumes no responsibility for injuries or health complications resulting from participation in training activities.
11. DATA RETENTION
User data may be retained as long as your account remains active and for up to thirty (30) days following termination of the relationship.
Backup copies of system data may be retained for up to ninety (90) days for disaster recovery purposes.
12. REFUND POLICY
Unless otherwise stated at the time of purchase, all sales of digital programs, coaching services, and educational materials are considered final.
If a refund policy is provided for a specific program or service, the terms of that policy will be clearly stated on the applicable sales page or purchase agreement.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Firefighter Peak Performance, LLC shall not be liable for indirect, incidental, consequential, or special damages arising from the use of the Product.
If liability is established, damages shall not exceed the amount paid by you for the Product during the previous billing period.
14. INDEMNIFICATION
You agree to indemnify and hold harmless Firefighter Peak Performance, LLC and its officers, employees, affiliates, partners, and contractors from any claims arising out of your misuse of the Product or breach of these Terms.
15. GOVERNING LAW
These Terms shall be governed by the laws of the State of Washington, United States.
Any disputes shall be resolved in the courts located within the State of Washington.
16. FORCE MAJEURE
The Company shall not be liable for failure to perform obligations due to events beyond its reasonable control, including natural disasters, war, terrorism, labor disputes, internet outages, or government actions.
17. SEVERABILITY
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18. HEADINGS
Section headings are provided for convenience only and do not affect interpretation of these Terms.
19. ASSIGNMENT
You may not assign rights under these Terms without written consent from the Company.
The Company may assign its rights under these Terms without restriction.
20. WAIVER
Failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
21. SURVIVAL
Provisions intended to survive termination shall remain in effect following termination.
22. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Firefighter Peak Performance, LLC regarding use of the Product.
